AI Usage Policy

This Artificial Intelligence Usage Policy outlines the terms for using iSpring's AI features and forms a part of your Master Services Agreement or other written or electronic agreement with iSpring.

By using iSpring products with AI features, you confirm that you have read, understood, and agree to this policy.

IF YOU DO NOT WISH TO ACCEPT THIS POLICY, IN THIS CASE YOU WILL NOT BE ABLE TO USE THE ISPRING AI FEATURES

Definitions

Artificial Intelligence (AI): A technical and scientific field devoted to engineered systems that generate outputs such as content, forecasts, recommendations, or decisions for a given set of human-defined objectives.

iSpring AI Feature refers to any tool, feature, or functionality within iSpring software products that uses algorithmic analysis, artificial intelligence, or machine learning technologies to help users in their work.

1. AI Features & Integrated Third-Party Services

iSpring AI features are integrated into the iSpring software products to assist with both content creation and administrative tasks.

All iSpring AI features leverage Integrated Third-Party AI Services, which are external AI tools, APIs, or platforms like OpenAI, AssemblyAI, and Google Cloud Text-to-Speech (TTS). These services process user input and generate outputs such as text, images, subtitles, and speech. They operate outside of iSpring's direct infrastructure and are governed by their own terms and policies, including data processing agreements.

2. Acceptable Use and Prohibitions

Your use of iSpring AI features must be for the purpose of assisting with your work in iSpring software products. You must use the AI features ethically and responsibly. You are strictly prohibited from using these features in any way that violates applicable laws or regulations, infringes on the rights of others, or is considered harmful, abusive, or otherwise inappropriate. This includes:

  • Illegal and Malicious Activities: Engaging in fraud, harassment, distributing illegal content, or creating/transmitting malware, viruses, or other harmful code.

  • Hate Speech and Harassment: Promoting hate speech, violence, or harassment against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other characteristics. You must carefully review all AI-generated content for biases and stereotypes.

  • Intellectual Property Infringement: Using the services to infringe upon the intellectual property rights of others, including copyright, trademark, and patent rights.

  • Sensitive and Confidential Data: You must not upload or share any data that is confidential, proprietary, or protected by regulation. This includes personal information of children under the age of 13. You are also responsible for not inputting confidential or sensitive data like Personally Identifiable Information (PII) or trade secrets into the system.

3. Data Processing and Security

iSpring is committed to protecting your data and complies with the international data protection laws and regulations. When you use an iSpring AI feature, your input data is directly and securely transmitted to the third-party service provider via API integrations, not processed solely within iSpring's infrastructure. The security measures include encrypting all data in transit using TLS 1.2 or higher protocols and using secure authentication methods like API keys. Data at rest within third-party providers is encrypted using standards like AES-256.The AI-generated output is then returned to the iSpring product.

iSpring Data Storage: A fundamental principle of our data handling policy is that iSpring stores input or output content, which may be retained temporarily according to our backup policy.

Third-Party Data Processing Terms: Data processed via Integrated Third-Party AI Services is subject to the provider's data policies. iSpring cannot directly audit, modify, or delete any data maintained by these external providers on their own systems. Any requests for data modification or deletion related to content residing with third-party providers must be directed to them.

Third-Party Data Retention:

Third-Party AI Services integrated into iSpring AI Features have their own data retention policies. By using iSpring AI Features, you agree to the applicable Third-Party AI Services data retention terms:

  • OpenAI: Data is retained for up to 30 days for abuse monitoring.

  • AssemblyAI: Data is immediately deleted after transient processing.

  • Google TTS: Data is retained for up to 30 days for operational reliability.

4. Intellectual Property and Accuracy of Outputs

Ownership of Content: You retain all title, ownership rights, and intellectual property rights in the content you own and upload to iSpring software products using AI features. You also own the output generated by the AI features. If content created using an AI feature has been modified by a human, those results belong to you.

Accuracy and Validation: Due to the nature of AI, output may not be unique and other users may receive similar results. iSpring does not guarantee the accuracy of any AI-generated output. You are fully responsible for reviewing all AI-generated content for factual accuracy, potential biases, and compliance with legal and regulatory frameworks before using or publishing it.

5. Disclaimers

iSpring provides AI tools, features, and functionality on an "as is" basis, with no warranties regarding their availability, effectiveness, or accuracy. You bear the sole risk when using these features.

Disclaimer of Liability

To the fullest extent permitted by law, iSpring disclaims all liability for any damages or losses arising from the use of its AI tools or integrated third-party services by you. This includes, but is not limited to:

  • Inaccuracies and Biases: iSpring is not responsible for any inaccuracies, errors, biases, or offensive content in AI-generated output.

  • Third-Party Security Incidents: iSpring disclaims any liability for security incidents affecting user data due to the failure of third-party AI service providers to protect data. iSpring does not guarantee the security of third-party infrastructure. iSpring also disclaims liability for security breaches, data loss, or other issues stemming from the operations or security practices of third-party providers.

  • Non-compliant or Infringing Output: iSpring is not liable for AI output that violates laws, infringes on intellectual property rights, or is subject to restrictive licensing.

  • Third-Party Liability: To the fullest extent permitted by law, iSpring disclaims any liability for any damages, losses, or claims arising from the use of our external services or their generated content.

Service Level Agreements (SLAs): iSpring's standard SLAs do not cover AI features and services. For example, the unavailability of an AI feature does not constitute unavailability of the associated Service for SLA purposes. iSpring does not offer a separate SLA specifically for AI features.

Your Responsibility: You assume full responsibility and liability for the legal and compliant use of the iSpring AI Feature by your users. You confirm that your users have read and understand the AI Features Disclaimer.

6. Policy Enforcement

Any violation of this policy may result in the immediate suspension or termination of your iSpring software product usage. Customers are responsible for ensuring their usage complies with this policy and must take appropriate measures to prevent prohibited activities. Violations, particularly with confidential data, will lead to an immediate access suspension during the investigation. Serious or repeated non-compliance may lead to full service agreement termination, as per the Master Services Agreement. Violators are fully liable for all direct and indirect damages, including financial, reputational, legal, and data breach costs.
